In the recent case of People v. Mackey a California Court of Appeals affirmed a 1996 case decision that said the police must get a search warrant from a Judge before they can put a GPS tracking device on a car. In this case the police tracked a suspected drug dealer for 26 days by placing a GPS device on his vehicle. However, the Court did not throw out the Mackey conviction because they said that the police officer had a reasonable belief that the action was legal. What a strange decision!
