On Wednesday, the U.S. Supreme Court in a unanimous decision decided that police cannot search someone’s cell phone without a search warrant, even if the person is under arrest for some crime. The Supreme Court found that we have privacy interests in our cell phones. Searching a cell phone is highly intrusive, particularly because of the large amount of data that can be stored on a cell phone. The Court also noted the particular danger because the cell phone can be linked to computers and other sources containing a huge amount of private information.
This is a great holding by the Supreme Court. Now police will not be able to delve into people’s private lives without clearance by the Court through a search warrant.
