Being Arrested Is An Extremely Traumatic Experience

Being arrested and charged with a crime may be one of the most traumatic events of your life. If it is a loved one of yours that has been arrested in may be equally traumatic. If it is you that has been taken to jail you may need help in finding a reliable bail bondsman to get your release from custody. If you are not able to make the original bail set by the jail we can work with you to provide the facts and arguments to the Court to enable the Judge to lower your bail. Once you contact us we will come to the jail immediately to consult with you and to begin to strategize as to how to get you the best possible outcome on your matter. Once we have met with you we will contact your loved ones to let them know how you are doing and also to begin to gather facts that will help us in defending you.

The first thing we will do is go over the charges with you and let you know what the prosecution has to prove to find you guilty and how much time is involved if you are convicted of the charged offense. We will talk with you and get your side of the story, and let you identify any witnesses for us that may help your case. Once you have provided the names and contact information for the witnesses, we will have one of our investigators find the witnesses and take their statements. Once we review the witnesses’ statements, if they are favorable to you, we will discuss with you providing the statements to the prosecution so that we can begin to educate the prosecution on your side of the story and to throw doubt on their case against you. Some of the witnesses I may interview myself to gather information and get a flavor of how that witness might come off.

In some cases, the scene of the crime may play an important roll in the defense of the case. If so, we will go out to investigate and photograph the scene of the alleged crime. We will take videos and make diagrams that will help explain your case

We seek to bond with our clients and really understand their stories. We want to know what makes them tick, so that we can better explain their stories to the prosecution or if necessary, to a jury. We will meet with you frequently, and we are always open to calls from you or your family. If it benefits you, we will help you get substance abuse, or psychological counselling. We will have our investigators speak to your friends and family in an effort to gather helpful information about you. We always will take your phone call, or get back to you as soon as possible.

To best defend you, you need an attorney that can perform an expert analysis of your case. We at Foos Gavin will analyze each aspect of the criminal charge and determine ways that we can attack the prosecution’s case. If the police conduct was unacceptable, we will look for a way to suppress the evidence you. If it will help defend your case we will file written arguments to the case that your case should be dismissed for some legal violation.

If there is a possible mental defense, for example, because of some mental defect or intoxication you did not understand what you were doing, we will look to defend the case on that basis. When helpful, we will hire a psychologist to interview you and write a report to the Court. If there is no way to win your case outright, we will analyze the possible sentences that you may face, and advise you on whether a plea bargain is in your best interest.

DEFENSE OF CANNABIS CULTIVATION ADMINISTRATIVE PENALTIES

Both the City and the County of Sacramento have passed Draconian ordinances, where they are levying extremely high Administrative Penalties if the property owner, or the tenant, cultivates over a certain number of cannabis plants, or cultivates any plants outside. We, at Foos Gavin, have many years of experience and a tremendous record of success in defending those hit with these high Administrative Penalties.

First, we will interview you and determine any defenses to the penalties. If you are the landlord, we will help demonstrate that you took all reasonable precautions against the actions by your tenant. We will gather witness statements, records, and a declaration from you establishing your lack of knowledge. We will put together a mitigation package to present to the City or County to show your lack of notice of the tenant's activities.

If you are the cultivator, we will work with you to establish legal reasons why you were cultivating cannabis, and present the best possible mitigation to the City or County. We will help you gather all positive evidence that will paint you in the best possible light to the Government.
