Being Arrested Is An Extremely Traumatic Experience

Being arrested and charged with a crime may be one of the most traumatic events of your life. If it is a loved one of yours that has been arrested in may be equally traumatic. If it is you that has been taken to jail you may need help in finding a reliable bail bondsman to get your release from custody. Where we at Foos Gavin Law can step in is to help you to obtain a fast, reliable bail bondsman at the cheapest possible price to you and who will put you through the least amount of hassle. Because of the relationships we have developed we can refer you to someone that will take care of you well, and at a reduced price.

If you are not able to make the original bail set by the jail we can work with you to provide the facts and arguments to the Court to enable the Judge to lower your bail. Once you contact us we will come to the jail immediately to consult with you and to begin to strategize as to how to get you the best possible outcome on your matter. Once we have met with you we will contact your loved ones to let them know how you are doing and also to begin to gather facts that will help us in defending you.

The first thing we will do is go over the charges with you and let you know what the prosecution has to prove to find you guilty and how much time is involved if you are convicted of the charged offense. We will talk with you and get your side of the story, and let you identify any witnesses for us that may help your case. Once you have provided the names and contact information for the witnesses, we will have one of our investigators find the witnesses and take their statements. Once we review the witnesses’ statements, if they are favorable to you, we will discuss with you providing the statements to the prosecution so that we can begin to educate the prosecution on your side of the story and to throw doubt on their case against you. Some of the witnesses I may interview myself to gather information and get a flavor of how that witness might come off.

In some cases, the scene of the crime may play an important roll in the defense of the case. If so, we will go out to investigate and photograph the scene of the alleged crime. We will take videos and make diagrams that will help explain your case

We seek to bond with our clients and really understand their stories. We want to know what makes them tick, so that we can better explain their stories to the prosecution or if necessary, to a jury. We will meet with you frequently, and we are always open to calls from you or your family. If it benefits you, we will help you get substance abuse, or psychological counselling. We will have our investigators speak to your friends and family in an effort to gather helpful information about you. We always will take your phone call, or get back to you as soon as possible.

To best defend you, you need an attorney that can perform an expert analysis of your case. We at Foos Gavin will analyze each aspect of the criminal charge and determine ways that we can attack the prosecution’s case. If the police conduct was unacceptable, we will look for a way to suppress the evidence you. If it will help defend your case we will file written arguments to the case that your case should be dismissed for some legal violation.

If there is a possible mental defense, for example, because of some mental defect or intoxication you did not understand what you were doing, we will look to defend the case on that basis. When helpful, we will hire a psychologist to interview you and write a report to the Court. If there is no way to win your case outright, we will analyze the possible sentences that you may face, and advise you on whether a plea bargain is in your best interest.

We will advise you whether it is in your best interest to accept a plea bargain or to take your case to trial. Our lawyers are trial-tested and ready to fight your case before a jury. David Foos has over 60 jury trials and has a high success rate. Mr. Foos is experienced to presenting a case to a jury and will present the best possible case.

David Foos has been a practicing criminal defense attorney for 38 years. Mr. Foos served 8 years as a Deputy Public Defender where he defended people accused of all types of crimes from Driving Under the Influence to thefts, to assaults, to sex crimes. Mr. Foos handled thousands of cases. After serving as a “P.D.” Mr. Foos was appointed to be a Judicial Officer in Sacramento. David served 16 years wearing the black robe and sat on all types of cases from misdemeanors, to D.U.I.s, to juvenile delinquency, to felonies. For one year Mr. Foos was the judicial officer who heard most of the Driving Under the Influence cases in Sacramento. In serving as a Public Defender and a Judicial Officer in Sacramento, Mr. Foos developed a wealth of relationships and contacts that he can put to use to assist you in your cases. Mr. Foos is an “insider” in the criminal justice system and his knowledge can greatly benefit you in your case.

Many people that are being investigated for a crime, but haven’t yet been charged, will benefit themselves by consulting with an experienced criminal defense attorney. Mr. Foos can provide you with advice that will benefit you in your police contacts, and if you wish, he can intervene for you with the criminal investigators. Often, Mr. Foos will advise you that it is not in your best interest to speak to the police and that you should invoke your constitutional rights. Nevertheless, it often is very valuable that you speak to a criminal defense attorney.

One of the best pieces of advice if you are in jail is to never discuss your case with anybody other than your criminal defense attorney. When you make a phone call or have a visit (accept with your attorney) the interaction is always recorded and can and will be used against you in Court. I have seen many cases fall on the statements that the prosecution have gathered from jailhouse calls or visits. The best advice is to save any discussion of your case for your attorney.

No one wants to get entangled in the criminal justice system. But, if you or a loved one have been criminally charged, you want an experienced, skilled attorney on your side. David Foos has the experience, the know-how, and the contacts in the system that will best benefit you in your case. Feel free to contact me and discuss your case on a no-cost basis. I can be reached at david@foosgavinlaw.com, or call me at (916) 779-3500 I look forward to speaking with you and helping you.

Driving under the influence

These days, penalties for a conviction for DUI are extremely severe. A DUI can result in loss of your driver's license, jail time, heavy fines, an increase in your insurance rates, and at least three years of probation. If you are charged with a DUI you should act fast and contact an experienced DUI attorney. There are important time limits that you must follow, for instance, you must apply for a hearing with the DMV within ten days of the arrest, to prevent your license from being suspended. You need an experienced attorney on your side who will defend your rights and who will fight for you every step of the way. David Foos brings forty-five years of experience and a sharp analytical mind to help you win your case. As a result of Mr. Foos' experience, he knows many of the players in the system and will use his relationships to benefit you.

In addition, Mr. Foos was a Judicial Officer on the Sacramento Superior Court for sixteen years and for a year was the Judicial Officer that judged many of the DUI cases in the County. As a result, Mr. Foos has a wealth of experience that will help you on your case. Mr. Foos has studied techniques for challenging the prosecution's evidence on DUI cases and is knowledgeable on the workings of the scientific evidence that the district attorney will bring. Mr. Foos will leave no stone unturned in searching out ways to fight your case. David brings with him a team of investigators and expert witnesses that will assist in your case. His investigators will interview all witnesses and his experts will help challenge the prosecution's scientific evidence. He will help you fight your license suspension with the Department of Motor Vehicles and will do everything possible to help you keep your license.

Associate Attorney, Robert Carroll, brings over 10 years of experience in defending DUI cases. Rob has filed many successful motions to dismiss cases due to violations of the 4th Amendment against illegal search and seizures, and has a vast knowledge of how to best defend these matters. Rob brings a down-to-earth and compassionate demeanor to his defense of matters, and will be highly effective in defending your case.

RESTRAINING ORDERS

We, at Foos Gavin Law Firm, specialize in both the defense and the prosecution of Restraining Orders. We can help you in Domestic Violence Restraining Orders, Civil Harassment Restraining Orders, Elder Abuse Restraining Orders, or Work-Place Restraining Orders.

We have had tremendous success throughout the years in both bringing and defending restraining orders. We will sit down with you, review all the allegations, hear your side of what happened, and then work with you to come up with a game plan. If helpful, we will have our investigators interview the important witnesses, and help draft the witnesses' declarations. We always work with you to put together a declaration regarding your side of the story, to be filed with the Court. If possible, we will make an effort to resolve the matter with the other party without having to fight in Court, however, if necessary, we will proceed to court with you and put on an aggressive case.

Should you need help with a restraining order, do not hesitate to call on us. The first consultation will be at no cost to you. Our number is 916-779-3500, or we can be reached on the web at david@foosgavinlaw.com.

DEFENSE OF CANNABIS CULTIVATION ADMINISTRATIVE PENALTIES

Both the City and the County of Sacramento have passed Draconian ordinances, where they are levying extremely high Administrative Penalties if the property owner, or the tenant, cultivates over a certain number of cannabis plants, or cultivates any plants outside. We, at Foos Gavin, have many years of experience and a tremendous record of success in defending those hit with these high Administrative Penalties.

First, we will interview you and determine any defenses to the penalties. If you are the landlord, we will help demonstrate that you took all reasonable precautions against the actions by your tenant. We will gather witness statements, records, and a declaration from you establishing your lack of knowledge. We will put together a mitigation package to present to the City or County to show your lack of notice of the tenant's activities.

If you are the cultivator, we will work with you to establish legal reasons why you were cultivating cannabis, and present the best possible mitigation to the City or County. We will help you gather all positive evidence that will paint you in the best possible light to the Government.

If you have been the unfortunate victim of an Administrative Penalty, do not hesitate to call us to consult on the matter. The initial consultation is at no cost to you. We can be reached at (916) 779 3500, or on the web at david@foosgavinlaw.com.
